What is Wrongful Death Law

Wrongful death law is a legal framework that allows surviving family members to seek compensation when a person's death is caused by the negligence, intentional actions, or misconduct of another party. It is a specialized area of Georgia law that focuses on providing justice and financial relief to those who have lost a loved one due to someone else's actions.

 

Georgia law actually provides two (2) distinct areas of recovery or the loss of a loved one:

 

  1. Statutory Wrongful Death Claim.  This section of Georgia law allows surviving relatives to seek compensation for the wrongful death of their loved one in an amount equal to the “The Full Value of the Life of the Decedent” O.C.G.A. § 51-4-2(a); O.C.G.A. § 51-4-5. 

 

  1. Survival Action/Estate Claims. This portion of Georgia law allows the Estate representative to seek pre-death pain and suffering, medical bills, funeral expenses, and other out of pocket expenses caused by the injury and death.

Types of Wrongful Death Cases
